Terms of Use
1. Acceptance of these Terms
By visiting or using the Site, you agree to these Terms of Use (“Terms”) and to our Privacy Policy. If you do not agree, please do not use the Site. If you use the Site on behalf of a company or other organization, you confirm you are authorized to accept these Terms for it.
Privacy, cookies, and analytics. Our Privacy Policy explains what information we collect and how we use it. In short: the Site is hosted by Vercel Inc., which processes technical information (such as IP address and server logs) to deliver and secure the Site; we use Google Analytics 4 to understand how the Site is used; and Inquire-form submissions are kept in our inquiry records. Your choices about cookies and analytics (such as browser settings and the Google Analytics opt-out browser add-on) are described in Section 6 of the Privacy Policy. If these Terms and the Privacy Policy ever differ about personal information, the Privacy Policy controls.
Minors. Anyone may browse the Site. Our services are for adults and businesses, so please submit the Inquire form only if you are 18 or older. The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 (see Section 11 of the Privacy Policy).
2. What the Site is for
The Site is a marketing website. It is provided for general information about Magic 7 Entertainment and to let you:
- Send us an inquiry through the Inquire form, and
- Schedule a lunch or coffee meeting through a Google Calendar appointment scheduling page.
The Site does not sell products or services online, and no purchase can be made through it.
3. No obligation from inquiries or meeting requests
Submitting the Inquire form or scheduling a meeting does not create a client relationship, contract, or obligation for you or for Magic 7 Entertainment. We may choose whether and how to respond to any inquiry. Any meeting scheduled through the Site is an informal introductory conversation only.
4. Service descriptions are not a contract
Descriptions on the Site of our services (marketing, show and business strategy consulting, and Administrative Support) are general descriptions only. They are not an offer, a promise of results, or a client contract. Service scope, fees, and terms will exist only in a separate written agreement signed by both you and Magic 7 Entertainment (see Section 14). Administrative Support means help with a client’s own calendar, emails, follow-through, and travel for dates already on the client’s schedule. It does not include finding, pitching, negotiating, or booking work for anyone.
5. We do not find or book work
This means:
- We do not procure, offer, promise, or attempt to procure employment or engagements for anyone.
- We do not negotiate or arrange employment or engagements for clients.
- We do not charge or take commissions on engagements or employment.
Nothing on the Site, in an inquiry response, or in a meeting should be understood as an offer or promise to obtain work or bookings for you. Our Administrative Support service helps clients manage dates they have already arranged themselves; it is not a way to find or get work.
6. Intellectual property
The Site and its content — including text, graphics, logos, the Magic 7 Entertainment name, images, and design — are owned by or licensed to Magic 7 Entertainment and are protected by intellectual property laws. You may view and share links to the Site for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or create derivative works from Site content without our prior written permission, except as allowed by law. Photos and video of people shown on the Site may not be copied or reused without permission.
Inquire form and other submissions. When you send us information through the Inquire form or by email, you confirm it is accurate and that you have the right to share it. We handle personal information in submissions as described in our Privacy Policy. Sending a submission does not create a client relationship (see Section 3). If you send us ideas or feedback, you agree we may use them without any obligation to you. Please do not send us confidential material or sensitive personal information (such as Social Security numbers, financial account details, or health information) through the Inquire form.
7. User conduct
When using the Site, you agree not to:
- Submit false, misleading, or someone else’s information
- Send spam, unsolicited advertising, or automated or bulk submissions
- Upload or transmit malicious code, or try to interfere with or disrupt the Site
- Try to gain unauthorized access to the Site, its systems, or the tools connected to it
- Scrape or harvest data from the Site by automated means without our permission
- Use the Site for any unlawful, harassing, or harmful purpose
We may block access or ignore submissions that violate these Terms.
8. Third-party links and services
The Site links to services operated by others, including the Google Calendar appointment scheduling page used to schedule meetings, and may link to social media or other websites. These third-party services are governed by their own terms and privacy policies. Magic 7 Entertainment does not control and is not responsible for third-party services, their content, availability, or practices. Your use of them is at your own risk.
9. Disclaimers (“as is”)
The Site is provided “as is” and “as available.” To the fullest extent allowed by law, Magic 7 Entertainment makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or free of harmful components, or that the content is complete or current. Site content is general information, not professional, legal, financial, or business advice for your specific situation.
10. Limitation of liability
To the fullest extent allowed by law, Magic 7 Entertainment and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or opportunities, arising from or related to your use of (or inability to use) the Site, even if we were told such damages were possible.
To the fullest extent allowed by law, our total liability for any claim related to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
What these Terms do not limit. Nothing in these Terms excludes or limits our responsibility for our own fraud, for willful injury to a person or property, or for violation of law, or any other responsibility that California law does not allow to be excluded or limited (see California Civil Code section 1668). If a court finds any part of these limits unenforceable, the rest still applies to the extent allowed by law.
11. Indemnification
If you misuse the Site or violate these Terms or the law, you agree to defend and hold harmless Magic 7 Entertainment and its members, managers, employees, and agents from reasonable claims, losses, and expenses (including reasonable attorneys’ fees) that result from that misuse or violation.
12. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute related to the Site or these Terms will be brought in the state or federal courts located in Los Angeles County, California, and you and Magic 7 Entertainment consent to their jurisdiction.
13. Changes to the Site and these Terms
We may change, suspend, or discontinue any part of the Site at any time. We may update these Terms from time to time by posting a new version on the Site and changing the effective date above. Your continued use of the Site after changes are posted means you accept the updated Terms. Changes apply going forward only and do not change any signed Client Services Agreement.
14. Services are governed by the Client Services Agreement
Any services Magic 7 Entertainment provides are governed by the Magic 7 Entertainment Client Services Agreement signed by you and Magic 7 Entertainment, not by these Terms. These Terms cover only your use of the Site. If there is any conflict between these Terms and a signed Client Services Agreement, the signed Client Services Agreement controls for the matters it covers.
15. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Magic 7 Entertainment about use of the Site (separate from any signed Client Services Agreement described in Section 14).
